485-x (Affordable Neighborhoods for New Yorkers): Current Operating Rules

What the Program Is

New York Real Property Tax Law §485-x created the Affordable Neighborhoods for New Yorkers program. HPD states that benefits are available for eligible multiple dwellings and conversions, other than hotels, with at least six units that commence construction after June 15, 2022 and on or before June 15, 2034, and complete on or before June 15, 2038.

Do not underwrite from a generic description of 485-x. The applicable benefit and restriction package depends on project size, location, tenure, commencement date, and the option selected in the HPD filing.

Current Rental Options

  • Option A large rental projects with 100 to 149 units receive a 35-year benefit and must make 25% of units affordable at an average of 80% of Area Median Income, subject to HPD's band limits.
  • Option A very large rental projects with at least 150 units in Zones A and B receive a 40-year benefit and must make 25% of units affordable at an average of 60% of Area Median Income, subject to HPD's band limits.
  • Option B applies to qualifying rental projects with 6 to 99 units and uses a different benefit and affordability structure.
  • Option C is a separate small-project option for qualifying projects with 6 to 10 units outside Manhattan.

These are program categories, not a substitute for the property's HPD application and restrictive declaration.

Permanent Restrictions

HPD states that every Affordable Housing Unit is permanently affordable. Restricted Units, meaning Affordable Housing Units and the rent-stabilized units used for Option C, are permanently rent stabilized. HPD separately states that a Market Unit is not stabilized solely because the property receives 485-x benefits unless that unit would be stabilized without the benefit.

Accordingly, do not say that every market-rate unit in a 485-x building is stabilized during the benefit period. Identify the unit category from the approved project records.

Filing and Operating Controls

For a project commencing on or after April 20, 2024, HPD requires the registration notice no later than six months after commencement. Options A and B also require the current HPD workbook and monitored marketing process. The owner should preserve the selected option, docket number, application, restrictive declaration, affordable-unit schedule, marketing approvals, tenant eligibility records, and rent-registration records.

Obtain the complete HPD file at acquisition or refinancing, then verify compliance with HPD or qualified counsel. Do not infer a unit's status from a tax bill, listing, or prior owner's rent roll.
