Local Law 97 Impact on Seller Strategy - Disclosure, Pricing, and Buyer Objections

Local Law 97 Impact on Seller Strategy - Disclosure, Pricing, and Buyer Objections

Start With the Building Record

Local Law 97 is a building-level issue, not a unit-level assumption. It generally covers buildings exceeding 25,000 gross square feet, groups of buildings on one tax lot exceeding 50,000 gross square feet, and condominium buildings under one board exceeding 50,000 gross square feet, subject to exceptions and different compliance pathways.

Before marketing, obtain:

  • the property's BBL and relevant BIN;
  • its entry and pathway in DOB's current Covered Buildings List;
  • the most recent emissions report and filing acknowledgment;
  • Request any DOB violation, adjustment, mitigation, or dispute record;
  • the board or owner's documented capital plan; and
  • enacted assessments or approved project contracts, if any.

Seller Communication Rule

State what the official record and building documents show. Do not convert the statutory $268-per-metric-ton excess-emissions rate into a unit estimate without the filed emissions, applicable limit, ownership allocation, and governing documents. Do not publish generic boiler, window, facade, or heat-pump cost ranges as if they were this building's required work.

Most covered buildings became subject to emissions limits beginning in 2024, with stricter limits beginning in 2030. The building's actual pathway can differ, particularly where regulated housing or another special category is involved.

Objection Handling

If a buyer asks whether LL97 will create an assessment, answer with the board-approved budget, assessment, or capital plan. If those records do not establish an amount, say that the amount is not yet established and direct the buyer to the managing agent and counsel. A documented unknown is more accurate than an invented allocation.

Botway Operating Rule

Botway may summarize the official coverage entry and seller-provided building records. It must not estimate a penalty, assessment, or retrofit cost without the corresponding building-specific evidence.

Does LL97 automatically apply to every large apartment building?

No. Apply the statutory thresholds and exceptions, then confirm the current DOB list and the specific BIN pathway.

Is the penalty always $268 times a building's total emissions?

No. The cited rate applies to emissions above the building's applicable limit, subject to current law and rules. The calculation requires verified building data.

Can a seller promise there will be no assessment?

Only governing building records can establish what has been approved. If the documents do not resolve the issue, the seller should describe it as undetermined.
