Can I sell a house before probate is complete?

In New York, you generally need Letters Testamentary or Letters of Administration from Surrogate's Court before you can legally transfer title. However, you can list and market the property while the probate process is underway, and even negotiate a contract contingent on court approval. This allows you to identify buyers and set terms while the legal process catches up. Work with a probate attorney to navigate timing.
