How does selling a home in probate work in New York?

In New York, the executor or administrator named in the will (or appointed by Surrogate's Court) has authority to sell estate property. If there is no will, an administrator must petition the court for Letters of Administration. The property must be appraised, and the executor has a fiduciary duty to obtain fair market value. Probate can take 6-18 months, and all beneficiaries must consent or be notified of the sale terms.
