HPD Violations - Current Categories, Correction Timelines, and Penalties
HPD Violations - Current Categories, Correction Timelines, and Penalties
Current Correction Periods
HPD's current table assigns the following periods from service of the violation before civil penalties apply if sought in Housing Court:
| Class | Condition | Current correction period |
|---|---|---|
| A | Non-hazardous | 90 days |
| B | Hazardous | 30 days |
| C | Lead paint, window guards, mold, mice/cockroaches, or rats | 21 days |
| C | Self-closing doors | 14 days |
| C | Heat and hot water | No correction period before penalties |
| C | Other immediately hazardous conditions | 24 hours |
The Notice of Violation controls the actual correction and certification dates for the cited condition. Correcting the physical condition is not the final step: the owner must also certify correction in the manner and time HPD requires.
Civil Penalties
HPD publishes a current penalty table and separate rows for condition-specific violations. Use that table and the actual Notice of Violation; do not carry a dollar amount from this article into a decision. The amount depends on the violation, issue date, building, duration, compliance, and enforcement posture.
Operating Procedure
- Retrieve the Notice and record the violation number, class, service date, correction date, and certification date.
- Route the condition to a qualified vendor immediately; do not wait for the end of the correction period.
- Preserve before/after evidence, invoices, permits, and professional certifications.
- Submit the correct certification form on time.
- Confirm the public record updates or use HPD's dismissal process when required.
- Never falsely certify; preserve the evidence supporting every certification.
HPD may perform emergency work on uncorrected immediately hazardous conditions and bill the property. The charge is property-specific; do not use the old blanket “cost plus 40%” statement without a current, directly applicable source.
