Local Law 97 Compliance for Rental Buildings
The Property-Specific Gate
Do not infer LL97 coverage from unit count, address, or a generic size estimate. Check DOB's current Covered Buildings List using both the tax lot (BBL) and building identifier (BIN), then verify the underlying Department of Finance square footage and the pathway assigned to that BIN.
LL97 generally covers buildings exceeding 25,000 gross square feet, groups on one tax lot exceeding 50,000 gross square feet, and condominium buildings under one board exceeding 50,000 gross square feet. Exceptions and alternative pathways apply. The 2026 list identifies different pathways, including timing differences for some buildings with rent-regulated units.
Compliance Record
Keep one current record containing:
- BBL and every relevant BIN;
- the current Covered Buildings List and pathway entry;
- the professional responsible for the report;
- emissions data and the applicable annual limit;
- BEAM submissions and acknowledgments;
- adjustments, deductions, alternatives, or mitigation requests; and
- open DOB violations or correspondence.
Most covered buildings have had emissions limits since 2024, with stricter limits beginning in 2030. The general excess-emissions penalty is $268 per metric ton of CO2-equivalent above the applicable limit, but the actual result depends on the verified report and applicable rules. Never substitute a generic retrofit estimate for building-specific engineering.
