Rent Registration and Annual Reporting - Current HCR Requirements

Rent Registration and Annual Reporting - Current HCR Requirements

Current Filing Rule

Owners of rent-stabilized premises must file:

  • an initial registration for each covered unit within 90 days after the premises becomes subject to rent stabilization; and
  • an annual registration for each covered unit by July 31 of the registration year.

The annual filing reports apartment information as of April 1. April 1 is the data snapshot date, not the filing deadline. HCR's current owner page describes the annual filing window as April 1 through July 31.

Owners must provide the tenant in occupancy with the registration information that pertains to that apartment. HCR treats late filings as delinquent and states that the rent laws authorize a $500 fine per unregistered unit for each month of delinquency.

Operating Procedure

  1. Maintain one legal-rent ledger per apartment with leases, riders, prior registrations, preferential rent, and documentary support for every increase.
  2. Reconcile the April 1 apartment status and rent to the lease file before submission.
  3. Submit through HCR's current Owner Rent Regulation Applications (ORRA) process unless HCR requires a paper form for that filing type.
  4. Preserve the submission, confirmation, tenant copy, and correction history.
  5. Investigate discrepancies rather than copying a prior year's number forward.

Registration does not by itself prove that a rent was lawful. The owner must retain the evidence supporting the rent and any claimed increase.
