Rent-Stabilized Lease Requirements - Current HCR Rider and Renewal Rules

Rent-Stabilized Lease Requirements - Current HCR Rider and Renewal Rules

Vacancy and Renewal Leases

HCR states that a rent-stabilized tenant may select a one- or two-year vacancy or renewal lease term. A completed current HCR lease rider or ETPA addendum must be attached to vacancy and renewal leases.

For New York City:

  • use the current RA-LR1 rider;
  • use HCR form RTP-8 for a renewal offer;
  • deliver the renewal offer by mail or personal delivery no more than 150 and no fewer than 90 days before the existing lease expires; and
  • generally keep the same terms and conditions as the expiring lease, subject to lawful changes.

Outside NYC in HCR-covered ETPA localities, use the current ETPA addendum and RTP-8 ETPA form. HCR states that the signed and dated renewal notice is sent by certified mail no more than 120 and no fewer than 90 days before expiration.

The tenant has 60 days to sign and return the renewal. For electronic lease execution, HCR requires the tenant's voluntary written consent on the current EL-TVC form; the owner cannot require electronic execution.

Operating Procedure

  1. Confirm stabilization status and locality before choosing forms.
  2. Download the current HCR form and rider at the time of the offer.
  3. Calculate only the lawful guideline or other documented increase.
  4. Complete the rider from the apartment's lease and rent records rather than memory.
  5. Preserve delivery evidence, signed documents, and any EL-TVC consent.
